Welcome to StreamifyUs LLC! The terms “we,” “us,” and “our” refer to StreamifyUs LLC. StreamifyUs LLC operates this website and provides software, tools, features, products, and services—including our QR Review Generator platform (collectively, the “Services”). Our Services are hosted by Shopify, which enables us to provide them to you.These Terms of Service (the “Terms”) describe your rights and responsibilities when using our Services. Please read carefully, as they include important information about your legal rights, warranty disclaimers, and limitations of liability. By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you should not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms, you represent that you are at least the age of majority in your state or province of residence. If you allow minors to use the Services on devices you own or manage, you are responsible for their activity.

To use certain features (including purchasing a subscription or generating QR codes), you may be asked to provide information such as your email, billing details, and payment information. You agree that all information provided is accurate, current, and complete, and that you have the rights necessary to provide it.

You are solely responsible for maintaining the confidentiality of your account credentials and all activity under your account. You may not sell, assign, or transfer your account to another person.

SECTION 2 – OUR SERVICES

StreamifyUs provides digital tools designed to help businesses:

Generate and customize QR codes for customer reviews.
Send review requests via SMS, email, or web links.
Filter reviews (e.g., directing positive reviews publicly and capturing negative feedback privately).
Manage customer communications and feedback in a centralized dashboard.

We reserve the right to modify or discontinue features at any time. We do not warrant that Services will always meet your expectations or be error-free.

SECTION 3 – ORDERS, SUBSCRIPTIONS & BILLING

Subscriptions: Access to our Services is provided on a subscription basis (monthly, quarterly, or six-month plans).
Payments: Payments are securely processed by Stripe. You agree to keep your payment information current.
Refunds: Subscription fees are non-refundable, except where required by law. Subscriptions may be paused but not refunded.
Orders for Physical Products (if applicable): When placing an order for any physical item (e.g., QR stands), you are making an offer to purchase. Orders are accepted only when confirmed by us.

SECTION 4 – PRICING

Prices, promotions, and discounts are subject to change without notice. The price charged will be the one in effect at the time of order. Prices do not include applicable taxes, fees, or shipping charges (if applicable).

SECTION 5 – SHIPPING & DELIVERY (Physical Products Only)

Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events beyond our control. Title and risk of loss transfer to you once products are handed to the carrier.

SECTION 6 – INTELLECTUAL PROPERTY

All trademarks, designs, software, features, and content related to the Services are the property of StreamifyUs LLC, its affiliates, or licensors, and are protected by intellectual property laws.

You may not copy, modify, distribute, reverse-engineer, or create derivative works of the Services without our written consent. Unauthorized use may violate applicable laws.

SECTION 7 – OPTIONAL TOOLS & THIRD-PARTY LINKS

We may provide access to tools or integrations (e.g., Google, Facebook, Yelp, Twilio, Stripe) provided by third parties. These are offered “as is” without warranties, and your use of them is entirely at your own risk.

We may also include links to third-party websites. We are not responsible for the content, products, or services provided by those third parties. Please review their policies before engaging.

SECTION 8 – RELATIONSHIP WITH SHOPIFY

Our Services are hosted by Shopify. While Shopify enables us to operate, all sales and services are between you and StreamifyUs LLC. Shopify is not responsible for any transactions or disputes between you and us.

SECTION 9 – PRIVACY

Your use of the Services is subject to our Privacy Policy, which explains how we collect, use, and protect your information. Shopify may also process certain information as part of hosting the Services.

SECTION 10 – USER CONTENT & FEEDBACK

If you submit feedback, suggestions, or reviews, you grant us a worldwide, royalty-free license to use and display such content for purposes of improving or promoting the Services. You agree that your content will not violate the rights of others or include unlawful or harmful material.

SECTION 11 – PROHIBITED USES

You may not use the Services to:

Violate laws or regulations.
Send spam, fraudulent review requests, or misleading communications.
Harass, defame, or abuse others.
Upload viruses, malware, or harmful code.
Collect personal data without proper consent.
Interfere with or disrupt the security of the Services.

We reserve the right to suspend or terminate accounts for prohibited uses.

SECTION 12 – TERMINATION

We may suspend or terminate your account or access to the Services at any time if you violate these Terms or fail to pay fees.

Upon termination, your right to use the Services ends immediately. Sections relating to intellectual property, liability, indemnification, and governing law will survive termination.

SECTION 13 – DISCLAIMER OF WARRANTIES

The Services are provided “as is” and “as available.” We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, timely, or error-free Services.

SECTION 14 – LIMITATION OF LIABILITY

To the fullest extent permitted by law, StreamifyUs LLC, Shopify, and their affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, revenue, data, or business opportunities.

Our total liability for any claim shall not exceed the amount you paid us in the past twelve (12) months.

SECTION 15 – INDEMNIFICATION

You agree to indemnify and hold harmless StreamifyUs LLC, Shopify, and their affiliates, officers, and employees from claims, damages, or expenses arising from your use of the Services or violation of these Terms.

SECTION 16 – GOVERNING LAW

These Terms are governed by the laws of the State of California. You agree that any disputes shall be resolved exclusively in the courts of Los Angeles County, California.

SECTION 17 – CHANGES TO TERMS

We may update these Terms from time to time. Updates will be posted on this page with the new effective date. Continued use of the Services after updates constitutes acceptance.

SECTION 18 – DISPUTE RESOLUTION

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Services:

Informal Resolution:You agree to first contact us at [email protected] and attempt to resolve the dispute informally.
Binding Arbitration: If the dispute cannot be resolved within thirty (30) days, it shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. The arbitration shall take place in Los Angeles County, California, unless we both agree otherwise.
No Class Actions: You and StreamifyUs LLC agree that disputes may only be brought in an individual capacity and not as part of a class action, class arbitration, or representative proceeding.
Court Option for Small Claims: Either party may bring a claim in small claims court in Los Angeles County, California, instead of arbitration, if eligible.
Governing Law: These Terms and the arbitration agreement are governed by the laws of the State of California, without regard to conflict of law principles.
